Perhaps you can also try with other mp3 files that you have (do they have the same problem?).
Never ever "upgrade" firmware, you'll find out that it is faster to kill your player this way, than to throw it out of a 10-storey building.
I'll suggest that if after a format, the problem still occurs, contact your seller for an exchange.
