There's only one way I know of to really tell. Did you do a double low level format using the mp3 utility with an encrypt/partition pass, as described in the hacked player thread?

In most respects, the Osmium is a great little player which I'm pretty happy with - except the memory size is misrepresented by a hacked partition table and careful product descriptions. Conventionally, 2GB is 2 GigaBytes, but in this case it's actually 2 GigaBits.

Uxcell have offered to replace it, but the end result will be the same. It's not faulty - just not what was excpected from the product descriptions.
