Why, when you were sold a 2GB player instead of 4GB, did you just complain about the CD? I find a lot of things in that ad a bit hard to swallow. Ex., he claims superior "65,000" color LCD. Anyone see a chpod with less than 65,000 LCD? I haven't. Anyway, d/l AMV player utiliites, which contains the converter & mp3 format util, and the telephone util from the software forum here, that's all you need, you dont need the cd.
For the price you paid, he should have been happy to supply one. (My Chinglish --> English translator is saying that he is telling you: "If you broke the CD, we are not responsible".
If you want to make an issue of it, then tell him this, he'll understand:
"CeeDee not brakey human, sellperson make brakey".
That will let him know that you are not responsible for the breakage.
