Default What is the best way to deal with hacked player seller

I' still awaiting delivery of my "8GB" player which i am hoping will turn out to be 2GB from ebay (other sellers have commented that their 4GB players were 2GB after formatting).

Before I set anything in motion I want to know what my options are. Looking at the sellers feedback it appears that in some cases people neg him for lack of communication, but others claim refunds quicly given, or item lost in post and refunds given. I have paid an extra £2 for postal insurance.
1. Option 1 would be to wait 3 weeks and claim the item never arrived and request either a refund or replacement player. Not ethical but neither is elling hacked players.
2. Option 2 would be to try negotiate say a £10 reduction since 2GB -players have sold for as low as £15 with free postage
3. Option 3 would be to try and claim under paypal, but i am not sure whether this means returning the player at my expense to HongKong, which i would be reluctant to do.

Any suggestions or advice would be appreciated.
