After using info from the forums I went to teh selalr and he has offered me 7.00 UK pounds refund via paypal - considering it was 19.00 incl p&p I am quite happy with that.
I will wait until I have the refund before giving any feedback though!

That is all it takes. eBay's past descisions have been in favor of the seller when a seller used that line. eBay will then close the dispute and you will get nothing.
Go for the partial refund. Also, the seller may try to extort a postive feedback from you by saying, "I give refund, you give good feedback". eBay does NOT consider that to be feedback extortion even though we all know it is.
