You're going against eBay's policy. Your dispute will close without a refund, if you don't provide the tracking number of your shippment. You have to send back the item first, to receive the refund. If you think so, that's not lawful, I'd like to tell you another story. I won a GPS receiver on eBay at a Chinese seller a month ago. this seller advertised free ship worldwide, but after the auction he/she asked me for $15 USD shipping cost. I didn't pay, but asked the seller to remove that shipping cost. The seller never responded, but opened an unpaid item dispute. In the dispute, I asked the seller: "O.k., if I pay for it, will you send this item?" The seller didn't respond, but closed the dispute and I have received an unpaid item strike. Now I have an unpaid item strike by a fraudulent seller, and I can do nothing. This is eBay's policy.
