I recently became victim to this scam. I can confirm that LCDGUARD is now BUY.MALL! as when i purchased a 4GB player from Buy.mall! the paypal receipt was from LCDGUARD. My 4GB unit turned out to be a 1GB unit. Ive sent them an email and failing that I will be placing a fraud claim. Theyre obviously aware of it as his ebay Feedback has negative ratings reflecting these hacks. |

i literelly just bought a 4gb mp4 from buymall...and i paid it straight away. I then thought i look at feedback and came across negative feedback and reference to this site. I dont know much about mp3 players but thought that a 4gb would be good to buy as its a decent size for my needs. How would i check if the player i get is actually a 4gb??? and what do i do if it isnt...would you just report it to ebay and paypal. What does hacked mean? |

The way I confirmed the size of my MP3 player was to follow some suggestions on here. The first thing I did was to upload as much data as I could to utilise the 4GB capacity. I found however that after around the 1GB mark everything was corrupted and unreadable. I then used the MP3 utility and turned off the disk encyption by sliding the slider all the way to the left. I found that this made the drive 1GB which is its real capacity. I have since lodged a claim with Paypal. I will only be happy with either a full refund or a replacement 4GB unit as that was my intended purchase. I wont be happy with a partial refund. |
samruti, Hacked is when they take a small memory chip and then make it read much larger. If you bought a 4GB chiPod it is pretty much going to be hacked. At present 2GB is the most memory that they can support.
You are entitiled to a full refund including shipping. "How to get full refund and how to expose fraudulent sellers? Check if the seller is still actively listing the same counterfeit items right now! After confirmimg receiving counterfeit item, you should complete the Item Not Received or Significantly Not as Described process dispute after 10 days of item closing date so that eBay or Paypal is alerted of the development of fraudulent situation. If you have paid by Paypal, you can also complete the Paypal Buyer Complaint Process to get refund from Paypal within 45 days. Since you have NOT been provided with what you have paid for, it does not falls into seller's return policy. You are covered by the 90 days protection period under eBay Standard Purchase Protection Program. Unless these fraudsters would risk their eBay account for permanent suspension, they will for sure be in contact with you quicker than anything else. You then regain control of the situation and the power is again on your side. Counterfeit is FRAUD, do not settle with the seller unless the seller is paying for all the associated return shipping cost of the item. You still own the right to provide negative feedback against the seller to alert the fraudulent situation to warn other eBayers. Provided that you have provided negative feedback to the seller and if subsequently the seller provides you with an unfair retaliatory negative feedback, you have a case to lodge against the seller by requesting eBay for feedback removal to fully protect your feedback. Effectively you will get your money back either from the seller or from eBay/Paypal. Most important by going through this, you have assisted the process of exposing fradulent sellers on eBay, which will result in permanent suspension of the seller's account. In most countries, FRAUD is a CRIMINAL offense and injunctions may be brought against the fraudsters to prevent them from moving on under a different name after being banned. Thus, you may choose to contact your law enforcement agencies or each respective brand manufacturers in your region, to report counterfeit and provide them with your item detail and the source of the item." You may also need to get a 3rd party to confirm that the player does not meet the specs of the player you purchased and if possible a high resolution photo of the open player so that the serial number on the memory chip can be clearly read. |

1GB = 512MB 2GB = 1GB Your unit has 50% of the advertised ram. Test unit past 50% of storage to see for yourself. Report this seller to eBay and file dispute with PayPal before it is too late to stop him from scamming others. |

Are there any suppliers (on ebay) that actually sell a legitimate 4GB unit. As i'm after a 4GB unit pretty much only. Not interested in anything smaller.
If so can the supplier name be supplied. So far ive purchased 2 x 4GB units. one turned out to be 1GB and the other became dead before I had a chance to tell. Cheers |

These players support a maximum of 2GB nand flash memory so stay away from 4GB and up chiPods. If you want a true 4GB player you need to look at the more expensive ones like the Meizu M6 (4GB approx $199.00 USD) or the Teclast T29 (4GB approx $149.00 USD). www.houseofdap.com |

You might also consider the Sandisk Sansa e250 to e280 players if you want to get something that is legitimate and fairly priced. It comes in various capacities as follows: Sansa e250 is 2 GB, e260 is 4 GB, e270 is 6 GB and the e280 is 8 GB. All are flash memory based and allow for expansion via a microSD card slot. The battery is apparently removable and replaceable. The players are available with product reviews posted (for what they're worth) at Tigerdirect.com and Futureshop.ca and should be widely available elsewhere as they are Sandisk products.

PayPal Dispute Resolution is a joke. They expected me to pay shipping costs to return my player to Buy.Mall! and only recieve less than half of what I paid in total. What a load of bullsh*t!

I am a newbie to this site and the reason I joined was that I too bought c*** players from unscrupulous eBay sellers (3 to be precise, they were for gifts for family members). They were all from different sellers (as they all wanted different kinds of players!). One of them I only managed to squeeze an £8 refund from, the other told me to return it for a full refund - minus the £6 P&P it cost me to return - and now they have filed an 'Unpaid Item Complaint' against me, which I have appealed against (3 times now) and provided proof of the original payment PLUS a tracking number for the returned item AND eBAY ARE DOING SWEET FA TO HELP ME!!). It seems that eBay only want to help the sellers who pay the fees and NOT innocent buyers. I also have an 'Unpaid Item Strike' against me that they will not remove because I refused to send a cheque for am iPod Nano that didn't exist (they knew it didn't exist because a large number of buyers were scammed by this person and eBay closed his account down - yet they still wouldn't remove the strike!! I asked them if they wanted me to send my money to a con-man and lose it, but they ignored me. I have appealed for them to remove this strike 10 times now - just for nuisance value!!) Oh, yes I forgot the 3rd one - the seller went out of business before I coukd even complain to ebay about that one! Sorry to drone on, but this is the only release I have for my fury - eBAY WON'T LISTEN!!!! PPS Also, PayPal is no guarantee either - as I found out to my cost - I won a refund through them but was told by PayPal that, "the seller has no funds in their account so we are uable to refund you" - yet they keep saying that the "safest way to pay is through PayPal" - YEAH RIGHT! |
Can't your CC company do something? Here (Netherlands) we can claim our money back up to 45 days after the withdrawl.

No, I'm afraid not. When I tried to claim the money back from them they said that I needed to try to retrieve the money again from PayPal.

I bought from buy.mall yesterday and only after that, i found about this forums and read about all the scam. grrrr, i bought a 4gb unit, hopefully it is at least 2gb! Is there anyway i can recover my money immediately or do i have to wait for the damn thing to arrive and make a complain in ebay? that bastard should be impaled, dishonest people make me so furious :evil: |

I am afraid I can give you no glimmer of hope re: eBay, they really don't give a flying fig - I just keep bombarding them with e-mails and details of transactions - and they go on ignoring me!!!! Oh! and I don't like to be the bringer of bad news, but one of the 4GB players I bought is only 1GB - that is in dispute also. I really do hope that you are one of the lucky ones - I personally will NEVER buy one of these players from eBay ever again, I'd rather pay more and be sure that I am getting what I pay for - GOOD LUCK!! :!: |

Yes, that's the way I look at it. I have vowed I will never buy another of these players from ebay, only from reputable online dealers like Uxcell.
In fact I have just ordered two for Christmas gifts from them to replace the rubbish I was lumbered with from eBay. Will keep you posted on how it goes. PS I think it's in stereo (well, at least I have sound coming through from BOTH earbuds) |

Just FYI, lcdguard is now trading as "buy.mall!".
I managed to get a hacked player - supposed to be 4GByte, was actually 1GByte. I opened the case and checked the Samsung chip against their database, and bingo it was 1Gbyte (1Gx8). After using the partition encryption and decryption tool in the disk utilities supplied with the player, it now shows the real size of 1GByte. I contacted the seller and asked for a partial refund as I dont want to waste more money sending the unit back. I await their response. If I get no joy, EBay and Paypal will have a complaint filed against the seller. Nobody produces a real 4GByte player yet (in the cloned Nano style) - this I now know from investigating the issue with various sources. 32Gbit flash chips are VERY expensive and thats why you dont see REAL 4GByte players in the Nano clone style. I agree Hazel. At least you get a bit more protection with sellers like Uxcell and VisualLand. I have a couple of different players from VL and they are all good, supplied as described and with warranty you know will actually be there if you need it.
EBay is a good source for many things, but like many forms of retail, there are sharks out there. VL & Uxcell are "more expensive" than some EBay sellers, but sometimes you actually do get what you pay for - eg. aftersales support and warranties. Sellers like lcdguard are the ones ruining EBay for genuine sellers. lcdguard for instance not only advertises 4GB nano-clone players when none exist yet, but charges 20quid postage and puts 2quid (31HKD) of stamps on the package. Obviously its to make the sale price look less and still make a profit, but for those who dont read the postage charges, it really is misleading, because EBay states that it will not address issues relating to "Postal Charge disagreements". Nice. |
Yes, also (in this country) you are not entitled to a refund of postage and packing paid, only the cost of the item. So when they charge £20 to £40 (and I have seen these amounts charged), they have probably made a profit on the wholesale price of the items in the first place. :evil:

I filed a claim against buy.mall AKA lcdguard the other day as my 4GB MP4 turned out to be 1GB. Within 24 hours PayPal had refunded my money as the seller agreed that is was incorrectly shipped. I stated on my complaint that the seller is selling devices marked as 4GB, with hacked firmware to make it look like its 4GB (thereby confirming the fraud, as opposed to just incorrect labelling) and additionally that 10 pounds was paid for shipping with 10 pounds added for "insurance". As the item received was not sent insured, and the total postage amounted to about 2 pounds, I explained that this was also dishonest. I offered to send images of the NAND FLASH chip showing the 1Gbx8 (1Gigabyte) chip inside the player, with a 4GB sticker on the case, plus a screenshot of the reported storage capacity (from Windows). I even said I would send a picture of the envelope with 31.10HKD stamps´on it (worth about 2 pounds) and the shipment number so HK Post could confirm it was uninsured. I was not asked for any further information.
In this case, I offered all the evidence I could as part of the claim, but was never asked for anything. Maybe I was just lucky, but I think it may also be that I stated that I had fairly convincing evidence and listed what it was. One thing to remember: If Insurance is added to the total as a separate service from shipping and handling, if they do not insure it with the courier it is sent with, you can demand the insurance payment back, and Paypal WILL do this. If its all in S&H, then they wont. "Dont let the ba5tards grind you down...." |

I was heartened by you getting you money back. I had filed a claim against this seller with paypal over two months ago. Same thing 1GB instead of 4GB. I got 3rd party evidence of the player only being 1GB, and done pretty much what you did. I was told to send the player back to get a FULL REFUND, which I did. and provided Paypal with the tracking information. Unfortunately paypay even though they received my tracking information (got an email confirming this and resent it when they asked), still managed to cancel my claim saying I hadn’t sent the information. My case is now in appeal (some 10 slow days now). Paypal just fob me off continuously, but hopefully all my previous leg work has helped you with your claim. All my case notes are now in the hands of my credit card company, as I have had enough of paypal being failpay. Incidental I have noticed today that the vermin buy.mall! Dosent seem to be selling the players anymore. I can only hope that eBay has finally got off its only caring about making money fat bottom and done something about it. I wish paypal would put a limit on his account to prevent this rouge trader from conning other people (mind you, you would be amazed how many still buy from him, given the amount of –ve feedback). Everybody get ready for him to switch to a new eBay account soon, as he has exhorted this one. BEWARE |

I too filed a complaint with PayPal, they also told me to return the item for a full refund. I returned it, got a tracking number (as they instructed me), faxed it to them and yes, they gave me a full refund (minus the postage it cost to return £6). Then the seller filed an 'Unpaid Item' case against me and no matter how many times I appealed to eBay (providing proof, that I had paid and had returned the item), but they totally ignored all 10 appeals and never acknowledged me once!! I now only buy anything on eBay (never MP3/MP4 players) if I can't get it anywhere else!! |
P.S.
One thing though, one of the players I had bought does actually show up in Windows as 4GB (even though it has been formatted under disk manager), but it corrupts everything above 1GB - 980MB) Anyone have any ideas why this would be? :?: |
Hazel thats because it would actually be a 1GB unit. Thats what they mean by it being a hacked u nit. Its made to show as a 4GB unit when it physically only has 1GB of memory.

Unfortunately, eBay does not do anything to unfair feedback. Such feedbacks does not fall under their removal policy which is outlined Here.
So pretty much if you give a negative to a scam seller, you'll most probably receive a negative too. And you can't do anything about it. However, there is SquareTrade which is an online mediator. You can file your unfair feedback case there and they will try to resolve it. If it rules out in your favour, SquareTrade has the authority to request eBay to remove the negative feedback on you. But everything comes with a price, it costs about $20 to be a member before they will take on your case. |

It is unfortunately very easy to make these players seem more than they are. You can "fix" the MBR (Master Boot Record) of a device to make it look bigger, but in these cases they have a "dodgy" version of an FDISK type utility which allows them to create a partition that is false. All that happens is when the device goes over the actual capacity it either wraps round to the start corrupting everything, or just plain gets lost in the ether. Either way, the sellers that do this should be strung up.... |
