Default [solved] Yet another eBay 4GB>2GB MP4 problem

Hey friends! First let me thank you all for this great forum, you all can be sure it's helping a lot of people.

I've got this "4GB" MP4 from mediabsolute on eBay for GBP 42.97 (incl. shipping) and it did came all the way from Hong Kong to Brazil. Thanks to some guides on this forum I could recognise my MP4 player as a 2 GB hacked one.
One might think its ok to have a 2 GB for only 25.99 GBP, but the thing is: The player's battery doesn't fully recharge and the earphones lasted only one day.

The one I bought was this

The point of this topic is either to warn you and whoever enters here once more not to buy from mediabsolute, and to ask for some advices:

I was able to get an answer from the seller when I said that I wanted full refund of the product (the information tadad1 gave here) was quite useful and thats why I'm asking for help.

After a few emails sent, the seller doesn't want to refund me the new shipping cost (she says something like "the return shipping is not include , when you return the item back , you must attach the VAT receipt and the player only, as you said the accessories can't work , throw it out .").

The last email I got from her was this one:
"GBP 42.97 is 2 kind of payment .
(1) GBP 25.99 item price
(2) GBP 16.98 shipping , handling and insurance fee

the above item include in your payment GBP 42.97 that is we refund to you "

And I've set a complain on PayPal already, so what should I do?
Accept GBP 42.97 and spend some money sending her back the product?
Not to settle with her untill she pays me the shipping back costs?

If I accept to deal with her, what am I supposed to do first? Get the payment, then send the product back? I don't think I can trust her when she says "send me back the product and I refund you".

And before you get too bored on reading this, here's her full name:
"Tsang H. Lam" (mediabsolute)
Please bear with me because my English is not as good as I'd like it to be =P But thanks anyway =D

Welcome Fierce, read this:
ebay's fake/ not rightly described items page
Where is stated:
"Since you have NOT been provided with what you have paid for, it does not falls into seller's return policy."
In other words, get your money refunded, and you do not have to send the player back, only out of politeness maybe, and only send the player back if the seller payed you back in full, plus the postage for sendback too.

ps your english is fine by the way, wish my portugese was like that

Fierce, I think this is something that needs to be addressed with eBay, by rights you should not have to pay for the return shipping as the trader is at fault and you should not be penalized for their dishonesty. The payment of return shipping appears to be a grey area and there is no mention of it in any of the terms and conditions I can find on eBay.
If eBay is involved under their 90 day protection plan they will charge you $25.00 (USD) for processing. So if you paid $80.00 (USD) you will only get $55.00 back.
Personally I think it sucks and I do not think eBay gives a shit or is doing enough to protect it's buyers in these situations.
I would love to see all dupped buyers get together and launch a class action against eBay for allowing this problem to knowingly continue.

Thank you Que and tadad1! You've helped me a lot with this =D

I guess I will just try to deal with mediabsolute through email. If she accepts to refund me without sending the mp4 back, then I take PayPal complaint back, otherwise, we'll have to settle things with PayPal's ""help"" =P

I think i'm going to add [solved] to this post when I have the outcome of it all. And regarding eBay's negligence about trully helping buyers, perhaps eBay itself is no more different from this episode's moral: Business can be a harsh thing, and you are on your own when buying, especially on the internet. (At least theoretically on your own, since we've got places like this very one)

Ok now here am I again, this time to show what Pay"Pal" wrote to my complain:

"The seller has offered to provide a full refund once you return the item in its original condition. Please send the item to the seller at the following address:

1903 Hin Ming Court, Tseung Kwun O, New Territories, Hong Kong

You are responsible for shipping and handling costs associated with returning the item. Once you ship the item, please provide us with an online tracking number by Nov. 17, 2006. This tracking number allows us to confirm that you shipped the item. Please understand that if you fail to provide this information, your case will automatically be closed."

Great mate, PayPal, always helping those who were fooled =D.
Disgusting.

Guess Ill have to keep this great mp4 of mine and perhaps use it as a toy for the cat ¬¬ ok. I shouldn't overvalue it. Sometimes it even works!

Jeezzzzz, what a bummer. Paypal is a joke, helping scammers in this wa! Nothing to expect from ebay? If you are in contact, and not sending the player back, you might as well send scammerman the link to this forum and topic, with his real name so nicely exposed. If it ain't his uncle.

I'm affraid I'm not willing to pay $25 to eBay for the process (in Brazilian Real USD 1 = 2,50 BRL)
And what to say? eBay and PayPal are the same in the end =/
I've sent scammerman the urls of this forum, of eBay's review, and everytime I say something about the fact of the mp4 being a hacked one, she just ignores that as if it wasnt something important

Money Money Money. Thats what she wants =P
Perhaps I could send her a negative feedback with this post's link and entitling it "HACKED MP4 BEWARE"

Who wants to bet she'll send me a negative feedback using nonsense arguments right away? Anyway, better save money to get an iPod someday xD
Thx Que o/

I'm mediabsolute, my name is Ms.Tsang, I would like to say this people want cheat my item, the below message/email receive from this buyer:

************************************************** ********

---------- Forwarded message ----------
From: Fierce <fircedeity@gmail.com>
Date: 08-Nov-2006 10:24
Subject: Re: item #330036041982 MP4 Player 4GB MP3 PMP FM Radio Movie BOXSET WHITE UK
To: "Medi@bsolute" <mediabsolute@gmail.com>

I am awaiting your answer. If you refund me 42.97 GBP without sending back the mp4 (because I am on my rights), I take off the PayPal complain.

************************************************** ******

I offer him return back the item for refund, but he reject, please think, if anyone asking for refund and reject return back the item, it will no seller on the world.

Your item bought from 10-Oct. At that time, the Samsung K9WA chips is USD 38. + the player ATJ2085 and LCD and the other IC is USD 22. + accessiory USD 2 + Shipping USD 6. = USD 68. The selling price is 42.97 pounds, deduct the fee from ebay and paypal, I get around 40 pounds, I have earn USD 5. in this deal, do you feel I over earn? And I offer full refund for the item back, First, I lost the shipping fee (from Hong Kong to Brazil), Second, I lost the price different from 10-Oct. (today the K9WA is USD 32, it means I lost USD 6. And third, the player be second hand, I also take this lost. Although I lost some, but I still offer full refund for the item back because you(some buyer) maybe not accept my product standard. But you just say want full refund and reject return the item back. Sorry, no free lunch on the world.

Mediabsolute, you sell players as 4 gigabyte but you know they are not. That is giving false information, intended to sell more. Everybody knows by know there are no 4 gigabyte mediaplayers, at least, the cheap ones you sell are not 4 gigabyte. But you keep selling them as such.
That is called scamming. The fault is yours, the loss should not be the buyers, he also should not loose money for sending the player back, because YOU are selling 2 gigs as 4 gigs. It is normal to pay for your own mistakes, not let someone else pay your way. Reason says you will have to pay a full refund, plus the cost for sending the player back to you.
But this all seems to be a setup to disencourage people to do anything about it, because they will loose money and end up with empty hands, paying for your misbehaviour. Unprecedented in any bussiness.
People, buy from official stores like uxcell.com, at least you can be shure about the memory size you order, and get fair shipping quotes.
