Thank you everyone for support.
My suggestion for everybody who was cheated by those sellers, and have reported it to ebay/paypal without receiving any reaction beyond the "automated reply" - write to eBay CEO. You can use the sample above, or create your own. Send it via registered/certified mail, or leave youeself a copy, and record the date. This way if we bring a lawsuit later, it would be easier to prove eBay negligence.

You did good with your letter. Very indepth.

It would make a great 'sample' letter to those who are in the same situation as you and might be 'afraid' to take further steps.

Keep up the good work.
The more we start actioning these problems, hopefully we can stamp out the bad traders who are selling hacked 4GB players.

I received the 4 MP4 players I purchased from you today.

I have a major problem with these players. They are FAKE!

They do NOT have 4GB of memory as your ebay ad states. They only have *1* GB of memory. These players have been *hacked* and fraudulently represented as having 4GB of memory.

As far as I am concerned, you have 3 options to resolve this issue.

1: You can issue me a 100% complete refund including all shipping charges for all 4 of these players and I will send them back to you at my expense after receiving my refund. I will email tracking number to prove I sent them back.

2: You can issue me a 75% refund of the purchase price for each of these players and I will keep them. Why 75%? Because I'm only receiving 25% of the memory I paid for. Therefore the way I see it 75% of my money was fraudulently obtained. The refund amount would be $146.27. After refund I would leave positive feedback for you.

3: You can do nothing. In which case I will leave negative feedback, file a claim with Paypal and my credit card company and file a police report with the police in your hometown of Blaine, MN. regarding your fraudulent activities.

You have 72 hours to respond to this email before I assume you have chosen option number 3. I have sent you this via personal email, and through ebay's member contact system. I will also attempt to contact you by telephone via the phone number provided by ebay within this 72 hour period.

I have just recently on Nov.05,06 bought the same mp3/mp4 player from blown-z. It is supposed to be a 4gb but I just read your post and I got it out. It is supposed to be for my son for Christmas. Can you tell me how to check to see how much memory it has on it? All it has is those two stickers on the back that says 4gb and FM. Also I will be filling a complaint to Ebay against him. The bad thing is that I left him good feedback. I plugged it in when it came in the mail and it seemed to work. I just didn't know anything about them. Any information will be greatly appreciated.

sexykaren , you can give your player a format using the guide Here.
This will reveal the true size of the player that you have bought.

I wish I had found this website before buying from blown_z. I too have 1gb player that was sold as a 4mb player. Now I am asking for a complete refund. I can't believe that both Ebay and Paypal allow sellers like this to remain on their sites.

I have checked this seller on ebay and people are claiming they bid on a 4GB and only get a 1GB. I didnt see the seller offering gigabyte(GB) players. Everything is offered in Gb(gigabit). It seems like the going price for a 4Gb player is around $50. Thats a sweet deal considering 1GB ipod nanos are going for $100. Also if you actually do the conversion 4 gigabit=512 megabytes. I think people are getting more then advertised. Just thought i would throw my .02 in

Everybody knows by now there are 8 bits in a byte, etcetera.
4 GB's everywhere!
Who with a common mind these days sells stuff in gigabits??? Nobody, unless as some last resort to keep the complainers you just scammed off your back.

i to was ripped off from this guy item number 200052069448 i dident know what was going on with my player it would crash and reboot its self then i came here funny thing is i got a paper with my player to come to this site how funny is that? i have tryed talking to ebay live help about 10 times all they give you is a damn link to there safety team and refuse to let me talk to some one witch i think they are all BOTS and not real people as they never reply fast or they dodge your question i asked to talk to the supervisor over 15 times and they never said yes or no so i went to my attorney general and filed a full report with them and also the police and now im getting in touch with lawyers and going after ebay as i see that over 30 people have sent ebay letters dateing back to april about this member and he is still on ebay and sells over 15 players aday and ebay want let you email people that you are not buying from or selling to so it is hard to let these people know i talked to one guy that bought 3 of them 2 for his doughters and one for a kid that is fighting to abodt for xmas i think it is sad and with xmas here people are buying them for loved ones and i think it is wroung its no longer blown-z im after im going after the boss of it all eBay
