Default Paypal dispute with Buy.Mall!


I started a paypal dispute with "buy.mall!" to reclaim the £28 i spent on a "hacked" 4GB player that was only 1GB.

However I recieved an email today from paypal asking for 3rd party evidence that my mp3 player is only 1GB and not 4GB as sold.

Looks like this is as far as I can take the dispute without me spending more cash. The seller will get away with it as its not worth me proceeding with this.

Seems to me that Paypal/Ebay are supporting the seller despite the fact that there are complaints/neg feedback against this seller every day.

Here's some of the email from paypal:

In order to continue with the investigation of your complaint, we must
request documentation to support your claim that the item is damaged or
significantly not as described. Please obtain a document (such as an
estimate or invoice) from an unbiased third-party, such as a dealer, repair
shop, appraiser, or another individual or organization that is qualified in
the area of the item in question (other than yourself). This document
should detail the extent of the damage or clearly explain how the item
received significantly differs from the item advertised. Please do not
proceed with any repairs or alterations to the item, as doing so will limit
PayPals ability to successfully resolve your claim, and may result in the
cancellation of your dispute. If possible, the document should include a
serial number and description of the item, and the dollar amount required
to complete the repairs necessary to correct the damage. This document must
be on letterhead that includes the name, address, and phone number of the
individual, business, or organization so that PayPal may contact them if
necessary.

We must receive your fax within 10 days from the date of this message in
order to proceed with the investigation of your claim. If we do not receive
your fax within 10 days, your claim will be cancelled. We are unable to
grant extensions to this time period. PayPal is unable to reimburse you for
any costs or fees that may be incurred in obtaining the requested
documents. Any documents you provide may also be supplied to the seller in
your dispute.

Paypal is a joke. They also stole money from me, well, they helped the seller who refunded me full before he sent me a hacked player to get away with it cheap, while I lost money twice due to the conversion from my local currency to the seller's, and back. Seller changed his shop name, could not give feedback because of that, and Ebay, that's even a bigger joke. You can put the facts right under their noses, but they still won't give a @#$%^!, but only give you some sentimental "that's bad, must be disappointing" pseudo-interest bogus answers.

Hi Guys,

I filed a claim against buy.mall AKA lcdguard the other day as my 4GB MP4 turned out to be 1GB. Within 24 hours PayPal had refunded my money as the seller agreed that is was incorrectly shipped. I stated on my complaint that the seller is selling devices marked as 4GB, with hacked firmware to make it look like its 4GB (thereby confirming the fraud, as opposed to just incorrect labelling) and additionally that 10 pounds was paid for shipping with 10 pounds added for "insurance". As the item received was not sent insured, and the total postage amounted to about 2 pounds, I explained that this was also dishonest. I offered to send images of the NAND FLASH chip showing the 1Gbx8 (1Gigabyte) chip inside the player, with a 4GB sticker on the case, plus a screenshot of the reported storage capacity (from Windows). I even said I would send a picture of the envelope with 31.10HKD stamps“on it (worth about 2 pounds) and the shipment number so HK Post could confirm it was uninsured. I was not asked for any further information.

In this case, I offered all the evidence I could as part of the claim, but was never asked for anything. Maybe I was just lucky, but I think it may also be that I stated that I had fairly convincing evidence and listed what it was.

Just my 2 cents....
