Default Filed complaint with BBB against Paypal


I filed a complaint today against paypal because i filed a dispute against hitekgear on 12/20/2006, and they have yet to relsove the issue. This seller knowingly sold me a 4GB player that only had 967mb of memory. I must say that it looks as if several other have also filed complaints. check out the list of complaints listed with BBB

Folks, here is what you all have been waiting to here, the results on my filing with the better business bureau against Paypal. I have x'ed out portions of the names, to protect me from the lawyer's

Consumer's Original Complaint :
Paypal an ebay company has failed to comply with their policy and procedure, with regards to the time it takes them to review a disputed claim. I opened a dispute on paypal site on 12/20/2006. Regarding an ebay item Mp4 player eBay auction number 290060405228 paid for using paypal services. I raised the dispute because the eBay seller knowingly sold me a MP4 player claiming to have 4gigabytes of memory; but only had 967mb of memory. I have made several call to both paypal and eBay and they continue to let my account sit in the review status rather than resolving the matter in their agreed upon terms (30 days). Today's date is 1/24/2007 making it more than 30 days that my dispute has been in the hands of paypal. To make matters worst, I filed another claim after this one and that claim has been closed. Guess why? This guy has removed all his funds from paypal, and no longer does business with eBay. So the dispute was closed in my favor, but there is no money to collect. Yes, he ran just like this criminal will do in the future when enough of the buyers file complaints on him. It's happening to thousands of buyers each day and they continue to favor the sellers rather than the buyer. Consumer's Desired Resolution:
I have asked paypal to support me in getting my refund from the ebay seller "hitekgear" for the amount I paid him including shipping cost $69.95. I provided the seller with all of my contact information including home address, and promised to ship him the player back once the refund was refunded. However, he has chosen to only offer $10.00 back and paypal continue to let it sit idle. I'm asking you BBB to please help resolve this multimillion dollar scam that continues to rob thousands of sellers like me. Paypal and EBay Company continue to show that they are all about the money and not customer service AND FAIRNESS. Thanks, (my contact info was here)

I sincerely apologize for the difficulties you have encountered while using PayPal. The company values your business and I want to do everything possible to resolve this matter. I have reviewed your PayPal account and your recent iniquiry to the Better Business Bureau. Please allow me to offer further explanation concerning your issue.
Our records indicate that you sent a payment to Gxxxxe Yxxxg, auctions@hitekgear.com, in the amount of $69.95 on December 10, 2006. On December 20, 2006, you filed a Buyer Complaint, PP-232-637-452, stating that the merchandise received was Not As Described. At this time, I can see that the complaint was resolved in your favor on February 7, 2007. In order to qualify for a refund for this complaint, you were requested to return the merchandise to Mr. Yxxxg.
To qualify for a refund, please return the item received to the seller in the same condition in which it was received. (You are responsible for shipping and handling costs for the returned merchandise.) The amount you will be eligible to receive is determined by the terms of our buyer protection policies and we may be unable to make a full recovery of your payment from the seller. Please review the buyer protection policies in our Legal Agreement before shipping the item back to the seller.
I apologize if you feel that we have not delivered the level of customer service you were expecting from PayPal. We make every effort to respond quickly, accurately, and thoroughly to the concerns and questions we receive by email or telephone. Your feedback is valuable and presents an opportunity to evaluate and continuously improve the level of service we provide to our members. PayPal will seek to resolve the claim within 30 days of the date the claim is filed, though such time frame may be extended, if appropriate, to accommodate the investigation. This policy applies only to the sale of tangible, physical goods and excludes all other sales and services, pursuant to section 3.b.3 within our Legal Agreement.
In response to your second complaint case, a review of your PayPal account reflects that on November 28, 2006, you sent a payment to Cxxxxxxxg Chi, chinadigitalpc@yahoo.com.hkin the amount of $48.00. Then, on December 23, 2006, you filed a Buyer Complaint, PP-233-899-645, citing Merchandise Not as Described.
In accordance with PayPal's User Agreement, PayPal investigated your claim and contacted the seller. The Buyer Complaint was found in your favor, as the seller did not present appropriate proof of shipment, a full refund or other evidence of a satisfactory resolution. We attempted to recover the $48.00 from the seller's PayPal account to provide a refund to you, however, there were insufficient funds available in the seller's account for a full refund.
Pursuant to the Buyer Complaint Policy, located in the PayPal Legal Agreement, the buyer will receive a recovery only if there are funds in the seller's account, "Our best efforts program to reimburse Users for losses only to the extent we are able to recover the funds from sellers.
Furthermore, clause 1.1 of the PayPal Legal Agreement states the following: " PayPal helps you make payments to and accept payments from third parties. PayPal is an independent contractor for all purposes, except that PayPal acts as your agent only with respect to the custody of your funds. PayPal does not have control of or liability for the products or services that are paid for with our Service. We do not guarantee the identity of any User or ensure that a buyer or a seller will complete a transaction."
Our records indicate this complaint was worked according to our policies as listed in the User Agreement to which you agreed when you created your account. Although we cannot further arbitrate your claim or guarantee resolution, please note, PayPal does not take fraud or illegal activities lightly. The seller's PayPal account has been limited from further use until the claim is amicably resolved with a full refund or cancellation of the complaint by yourself.
Because we value you as a member and want your experience with PayPal to be a positive one, I am going to issue you a credit in the amount of $48.00, as a one-time courtesy. Please understand that this is a one-time exception, and we will be unable to make any further exceptions to this policy going forward. Please allow 2 business days for this to be reflected in your PayPal balance.
We deeply regret that you have had this experience, as we continually strive to exceed our customers' expectations to provide a safe, secure method to send and receive money online. We truly value your business and hope that you will continue to use our service for your online transactions, and give us the opportunity to demonstrate why PayPal is the leading online payment service in the industry.

It is only when the matter is pushed all the way to BBB that Paypal decided to do something about it.

So if the fraudulant seller closes his paypal account your screwed??
Isn't that the most feared thing to worry about when using Ebay/Paypal is that you'd get screwed by a seller just like that, but still Paypal makes you feel safe to go ahead and then afterwards reminds you that they have this loophole.
Isn't that a sweet deal for paypal?
