Thinking about it a little more,
They probably spent more on shipping than the actual player, so I dont think any little chinese kids are gonna starve if you dont send it back.

When I said a lesson to be learned, I meant that you tried to get an 8gb player for 40 bucks, if its too good to be true then...

using the car metaphor, If someone tried to sell you a corvette for 1000 dollars and your supposed to buy it without actually seeing it or meeting the seller, then you might wanna question them and do some research.
just my two cents.

good luck.

Once these thieves dishonour the agreement, there is NO contract. By scamming you by blatantly misrepresenting what they were selling they were committing FRAUD, pure and simple. They dont have any rights as far as I am concerned. Ebay are also guilty of aiding and abetting these scumbags. When you read the Ebay Community garbage it makes me so feckin angry. They talk of "values" and "fairplay" while stealing money out of your back pocket. There are a great number of buyers with zero feedback who had absolutely no chance of spotting these scams. Most of them were probably teenagers who wanted the "latest thing" and thought Ebay was the place to get it. Time and time again I have reported these illegal listings only for nothing to be done, although I have noticed a reduction in the 8GB "nano" type scams over the past couple of weeks. I have concentrated in reporting that type of listing over the past few weeks. It started off that I was reporting over thirty a night, now it is almost down to single figures. Ebay take so long to act, that is if they act at all.
Must stop now, RANTING again

I totally agree with you man i am a teenager in collage and just wanted a good deal since money is tight and i needed an mp3 player for work because you would go insane with out one where i work. your right i agreed to his return policy with an 8GB mp4 player not a 1GB hacked mp4 so his return policy isnt even worth my reading. Instead of losing 40$ on a player i didnt want, i just ended up with a free player and my 40$ back and good feed back on ebay thanks alot halitele for your fast shipping and no problem on my fast payment it was great getting it back! =) thanks to the helpful users on here.

Frankly to me, when negotiating with a scammer, i'd say "go and fly a kite".

Being a bigger man and paying for these "lessons" which really in fact are not lessons but scams, is just plain dumb.

So lets say if you bought a car from a car dealer from another state. You paid for the purchase price plus transport costs plus any other taxes.
You and the dealer agreed on a V8 engine, but the car came with a V6 engine.
So are you gonna be the bigger man and send the car back at your OWN cost to get a refund of the purchase price only? Or you gonna go all out to sue and get every single cent from the dealer?

Seriously this is a matter of dishonest sellers. They advertise the players as 4GB or 8GB, but in actual fact is only 1GB or 512MB.
They AGREED to sell you a 4GB or 8GB, but they broke the agreement by selling you something else.

So basically to people who do not honor agreements they set out, personally i feel not obligated to honor any agreements set forth after by me.

Exactly what I was thinking! 8)
