Default Nano in listing title, is it definately a misrepresentation?


I was wondering if using the word "Nano" in a listing title is considered okay. As far as I am concerned it is misrepresentation. Anyone have any legal thoughts about it? :roll:

Dunno, but Creative have used it before for their players, maybe it has to say "Ipod Nano" to be wrong.

Thanks for that knob, it looks like the scammers can get away with using it. Some sellers are using it to get 3 times the price of an 8GB MP4 player, which is the same thing. Take a look at matsfactory items next time you are on Ebay. Of course, the chances are they are not getting 8GB either.

Yeah now we know why Apple are not too fussed about the use of the word "Nano".
Looks like it's probably the "Apple Ipod" bit that means more to them.
They have had problems with "Apple" records if I remember right too.

His title is actually a really clever bit of misdirection, isn't it? He uses "Nano" to describe the device, then gets away with keyword spamming so that it will show up in searches for an Apple iPod Nano by including what would seem to be a "genuine" Apple part for it. The cheek!

However, what he can and should be stopped for is more basic: every picture in the auction is lifted from Apple and then photoshopped. The screen is not a consistent size, and I'm sure the touchwheel is not identical to an iPod, or ti would draw a lawsuit from Apple.

Speaking of the images, they have two different watermarks on them. Neither is "matsfactory". That alone could be used to cause issues for him. I can't read the owner, but I'm sure even among scammers, stealing images can get someone in trouble...

Yes Nola, the watermarks confirm that the seller used to be known as mokajud, a scammer of old repute, its even in his contact email address somewhere on the listings. I have reported the photo aspect, but Ebay.co.uk dont seem too bothered about it. I have however noticed that using the word Nano and the photo thing is not so common in America. Maybe if it is reported through Ebay.com something may get done, you fancy giving it a shot Nola?
