he`s selling mp5 16 GB for $38, I asked him about real memory but no reply.

Perhaps also check the feedback and see if there are any negative feedback from the buyers?

Is he a new member? What else is the seller selling?

I would be very cautious when buying from a new member (or member with very low feedback) and all they are selling are 16GB MP5 players.
