Default Has anyone reported these people to E-Bay?


I did a search of the person I bought my MP4 2GB (which may have about 512 on it) player from (powersellerturbo) and found that he has not only been selling faudulent MP3's and MP4s he has been selling fraudulent sandisk complete with new stickers and fake numbers (http://www.flickr.com/photos/squishy/92168553/)
Has anyone tried to get thier money back? I have only had mine 2 days and sent him 3 e-mails with no response. He asks that any disputes be sent to his aol address but I also sent them to him ebay address for proof. He doesn't have a bad rating on ebay but that could be because he doesn't give you feedback to till you leave yours. Unfortunately we all know ebay and paypal are the same and this person has a rating of over 35,000 customers so they may not care to much about the little guy. We will see.
He says he doesn't give refunds only exchanges, I believe he is referring to DEFECTIVE merchandise and not FRAUDULENT merchandise.
Has anyone gotten thier money back or even tried?

Its actually not that hard to get your money back, there are many ways in which you can recoup your losses.

Firstly you should file a Significantly not as described claim with ebay. If you paid by paypal, paypal will not help you get your funds back unless you took that buyer gaurentee option (which you would have had to pay a little extra for). PayPal won't refund on grounds that the item arrived and wasn't as described. As long as the seller shipped the stuff and he can submit tracking, paypal won't help you.

However if you used your credit card or even debit card to pay for the player, then contact your credit card and ask them to file a chargeback.

After you have done the above two, you will probably get a response from the seller.

Lastly, if the seller is selling fake products, then you should contact either your local police department or the sellers local police department (you probably have the sellers address either from a invoice or on the shipping label).

If both ebay can't get your funds and you didn't pay by credit card and the seller isn't responding to your emails, then contact HIS (not your) local police department. Nothing gets a person to respond and refund someones money when they got the PoPo calling them.
